Can a B-Khata House be Sold without OC?

Buying or selling properties sounds easy unless one actually opts for it. Our company is going to have a new branch soon and the property they chose had B-khata without OC. When our manager was discussing this topic I asked her

OC and she said legally no but if you want you can. I haven’t bought any property as of now so I did not even know what A and B khata mean and many of you might be in the same position. To clear things out let me state each and every detail about A khata, B khata and OC here.

  What is A khata and B khata?

A property must follow the rules of construction but there are several properties that do not. If a property abides by the rules and the property tax of it gets cleared, it falls under A khata. Such properties can be sold or bought anytime without hesitation. They are legal in the eyes of the government so their process of selling or buying gets easy.

B khata properties are just the opposite. A property that violates the laws of construction or has taxes pending to be cleared, falls under the B khata type. Such properties remain illegal according to the government. You can buy or sell a B khata property but do remember there is severe risk in it like you won’t be able to avail loan against it.

  What is an OC certificate?

OC certificate stands for Occupancy Certificate, a document stating whether a property abides by the national building codes and is suitable for occupancy or not. 

  Can a property get sold without OC?

Be it A khata or B khata property, a property without OC cannot get sold legally. But if a buyer is ready to take the risk then the property can get sold. But as I mentioned, the buyer will face several problems in future. 

 

Is it possible to get A khata without OC?

Without OC you won’t get A khata. A khata property is legal. It follows all norms and has all certificates needed. To get an A khata certificate you will need to show the OC certificate first and without it, you won’t be able to get the A khata for your property.

 

Our company had to cancel buying that B khata property as well.
