Hi there,

As far as I know, you can rent out a property if you are an NRI. The property should be in the name of NRI. And the renter needs to pay the rent to an NRE or NRO account. The payer of the rent should obtain a TAN Number and deduct 30% TDS from the rent in this case. He has to provide the TDS certificate to NRI as well. 

Also, if you are a foreigner you cannot buy or sell property in India. However, you can buy a property after RBI’s approval if the property is acquired from the person who inherited it from a person who was a resident of India. If you are a citizen from Pakistan, Bangladesh, Sri Lanka, Afghanistan, China, Iran, Nepal, or Bhutan you cannot buy immovable property. People who are residing in India will be allowed to buy the land after RBI's approval.
