A few months back, my brother asked me, can a landlord charge fines? I looked into this because I didn't have an idea about it. I found a landlord has the authority to impose fines on renters, but only if the penalties are specified and approved in the rental agreement. Can Landlords Fine Tenants?

To the best of my knowledge, the Rent Control Act of 1948 governs the relationship between landlords and tenants in India. Therefore, this act prohibits landlords from imposing fines on renters, but for a certain cause, they can.

  • If a fine is stipulated within the agreement, for instance, a late fee for overdue rent, then the tenant is contractually obligated to pay it. 

  • Landlords cannot impose arbitrary or excessive fines beyond what is agreed upon, as this would be seen as exploitative and could be legally challenged by the tenant.
