As a homeowner, I also had this query: can a landlord discriminate?

I hence asked one of my colleagues, a legal expert. He told me that in India, discrimination by landlords against tenants based on specific traits is prohibited. Landlords can sometimes discriminate against tenants, but no specific anti-discrimination law prohibits religious, caste, gender, marital status, or ethnic discrimination in rental housing. 

Can I Discriminate When Renting My Home?

It is against the law for landlords to treat tenants differently. 

  • The citizens of India protected against the discrimination of religion, race, caste, sex, or place of birth with the shield afforded by Article 14 Right to Equality, Article 15 Prohibition of Discrimination, and Article 21 Right to Life. This establishes a broader context of equality and fairness.

  • Most tenants in actual practice suffer from discrimination along religious lines. For example, non-Muslims or Muslims refused homes in specific areas. 

  • Women, especially single women, suffer prejudice from landlords who use and cite either moral reasons or supposedly prevailing societal norms for not allotting homes for them.

  • Constitutional provisions stated the courts may be approached as and when unequal treatment takes place.
