I had the same query, can a landlord have cameras in the house? When I researched about it, I found that in India, since it would violate the tenant's right to privacy, a landlord can't place cameras within a rental home or flat.

  • If you see Article 21 of the Indian Constitution, you will find installing surveillance cameras in a tenant's private quarters, including bedrooms, bathrooms, or living rooms, would be an infringement of their right to privacy.

  • The landlord should respect the tenant's right to privacy in their house since tenants have a right to enjoy the property they rent in a private setting.

  • But landlords can place security cameras in common places. They can put it in the building's entrance, corridors, parking lots, or outdoor areas that are not the tenant's private residence.

  • These areas are not considered private, so surveillance there is allowed as long as it is justified by security concerns and is disclosed to the tenants beforehand.

Just letting you know, as far as I know, tenants can protest if their landlord places cameras inside their rental property without their permission. If such things happen, they can approach consumer forums or a rent control authority.
