A month ago, my brother found the perfect rental apartment. When he informed the landlord about their pet dog, he refused to rent the place to them. After doing some research on can a landlord refuse pets, I found that although there is no such rule, landlords have the right to reject dogs in certain situations.

Can You Refuse Pets As A Landlord?

My brother informed me that while housing societies couldn’t enforce a blanket ban, landlords still had the right to set pet policies. Even though there is no law that requires individuals to keep pets in rental houses, the decision concerning the existence of pets in their rentals is entirely in the hands of the landlords. Here is a general guideline for the situation of pets in rented accommodations in India: 

  • Many housing societies and apartment complexes of their own have restrictions about pets. 

  • In Indian laws, this issue of pets in rented accommodations is nowhere to be found, even in a Transfer of Property Act, 1882. Whether to keep a pet on his rented property is the decision of the landlord. Mostly, the landlords do not allow or restrict pets to their properties.

  • Landlords must include within the lease agreement "no pets" policy, and if the tenant signed that lease with such a clause attached, they cannot change the terms of that change.
