Hi. I was living in a rented apartment and had to shift to another city within a week due to a transfer. I had to vacate the place earlier than what was agreed on because of this reason. Can a Tenant Terminate a Lease Early?

To put it straight, yes it is possible for you as a tenant to vacate the rented place before the stated period. However, there are a couple of conditions attached to this that you must check.

  1. Early termination is possible if a ‘break clause’ regarding the same is mentioned in the rental agreement. Here, a break clause means that in a certain circumstance, the tenant is allowed to vacate the place before the stipulated time. Here, the tenant and the landlord need to follow whatever is written in the clause.

  2. If there is no such clause mentioned in the agreement, things are most likely in the hands of the landlord. Generally, you need to provide a month's notice before moving out. However, you might have to urgently shift due to some reason. In such a case, the landlord usually asks for the rent for the notice period. You must note that this is the period when you won’t be living in the house.
