Car parking is a top priority for homebuyers when it comes to the factors that influence their choices of properties. Finding parking in residential neighbourhoods has become a daily struggle. RERA has developed some rules to help clear up the uncertainty as there is a lot of misinformation in relation to parking spaces. I’ve provided a few RERA rules for parking allotment. Hence, before buying a property you should go through the RERA rules to avoid any confusion.

Can builder allot parking space?

High-rise societies do not have a comprehensive parking policy. In housing societies, parking spaces are considered common facilities. In addition to the real estate legislation, the regulations that control the construction of apartments in a number of States indicate that the car parking facility belongs to the common spaces and is not included in the floor area ratio given to the developer. 

Parking spaces in a residential community, therefore, belong to all of the stakeholders, and a developer is not allowed to lawfully sell/allot them.

RERA rules for parking allotment:

  • Builders are prohibited from selling or allocating open parking spots under Section 206 of the Real Estate Act.

  • According to the RERA Act, open parking spots constitute a part of the project's common area.

  • The open parking spaces must be transferred in the housing society's name and included in the deed of conveyance.
