The Income-tax laws are very stringent and confusing. While filing ITR I always ponder about various HRA queries. One such query is can HRA be claimed for own house? I have done some research and I would like to share my findings. If you have taken a home loan and live in the house that you bought with it. You will not be eligible for HRA because you live in your own home.

Previously we were staying in our own home. However, we sold it out and moved to a rented apartment. Since me and my partner are both employed and qualified for HRA. I was skeptical about, can I pay rent to my spouse and claim HRA? 

It was since then that I realised, from Mr. Srivasu’s answer, that I cannot pay rent to my wife as she is not owning the flat where we were staying. Hence, we decided instead of me paying the entire rent to the landlord, I should share it with my spouse to save more money on taxes.

The key question now is how much of the HRA claim should be shared between the husband and wife. Here are some broad guidelines to follow:

  • If both the husband and wife are in the same tax bracket, the rent can be split 50:50 and more tax savings can be realised

  • If one person is in a higher tax bracket, however, he or she should claim a larger portion of the rent paid.

  • In an ideal situation, the individual in the higher tax bracket pays 120 percent of the HRA allowance as rent, while the other partner pays the remainder

Note that both the husband and wife must pay their portion of the rent individually to the landlord and receive separate receipts in order to claim tax deductions on the rent paid. If this isn't practicable, one person can pay the rent to the landlord while the other pays his or her half to the partner. 

One thing to keep in mind is that rental payments to a partner must be made via bank transfer or check rather than cash. However, income tax laws are ever-changing and you should always keep an eye on its laws and rules.
