Many people these days are keeping pets in their apartments. However, because of this, a lot of conflicts are happening, and landlords are asking people to vacate their homes. I was in a similar situation as my landlord had asked me to vacate the house because of my pet dog. Since I wasn’t aware of the rules, I got in touch with a lawyer and asked him can landlord kick you out for pets. He said no, the landlord can not evict you just because of a pet.

Can a Landlord Kick You Out for Having a Pet?

The lawyer said a landlord can’t kick out a tenant just for living with a pet. According to him, living with an animal companion is allowed under Article 51A(g) and Article 21 of the Constitution of India. 

  • He also said that this is allowed as long as I don't violate any municipal laws.

  • Until then, no one can object to me having pets at my home. 

  • The lawyer also said that abandoning a pet violates the law and I can file a complaint at the police station as well.

  • Apart from the police station, I could also reach out to the ward office of my municipal corporation and any local NGOs for help.
