Renting a property can be very tricky! When I shifted to Delhi, my friends shared their stories of their landlords and warned me about the risk I was taking. They also told me that sometimes their landlords come and go in their properties at will. That’s when I asked my lawyer uncle this question: Can my landlord enter the property without my permission?
He told me that there are many laws that protect your privacy as a tenant, even if the terms related to this issue ain’t mentioned in a rental agreement. Yes, the landlord may own the premises, but that does not give them the right to do whatever they want.
Landlord Right of EntryOnce a property has been rented out, the landlord doesn’t have the right to enter the property except in emergencies. For other reasons, the landlord is required to give prior notice or communication, and ‘surprise checks’ etc cannot be carried out according to the law.
Tenants have the right to enjoy peaceful possession of the property without any encumbrance or disturbance from anyone including the landlord.
Even after giving the notice, the landlord should have a good reason to enter the property. In most cases, the landlord can enter the property:
To ensure the property is meeting building safety codes or to inspect for safety issues
To show the house to prospective tenants if your term is ending
To make repairs
In an emergency
