NRI Buying Property in India Power of Attorney is Mandatory or Not?

When an NRI purchases or sells residential property in India, the Registration Act of 1908 mandates that both parties must physically be present to register the transaction. 

The NRI must sign a general power of attorney (POA) empowering the person who would handle the transaction on his behalf if he is not physically present in India for the registration of the property or the disbursement of the loan.

Steps to Execute the POA:
  • If all NRI applicants are physically present in India before disbursement, POAs can be executed in India or abroad.

  • When a customer executes a POA abroad,

  3. all pages need to be signed by the NRI applicant(s). 

  4. It needs to be attested by a public notary or by the Indian Embassy/Consulate. Only attestation from the Indian Embassy is recognised in nations that are part of the Gulf Cooperation Council (GCC).

  5. The original copy needs to be sent to the POA holder in India and notarized in addition to bearing the POA holder's signature after it has been attested.
