My cousin intends to travel to India and has an OCI (Overseas Citizen of India) card. Because Aadhaar can expedite the KYC processes for all domestic transactions, he wished to apply for an Aadhaar card. So, he asked to find out can OCI get Aadhar card. As I wasn't sure, I researched and found an OCI cardholder is ineligible to get an Aadhaar card unnecessarily. It is because the Aadhaar system is intended for Indian residents.
According to the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, only residents of India are eligible for an Aadhaar card.
A “resident” in this context is defined as an individual who has lived in India for at least 182 days in the 12 months immediately before applying for Aadhaar.
However, some OCIs may qualify if they meet this residency requirement. If an OCI cardholder has lived in India for 182 days or more, they can apply for Aadhaar with the required documents.
They must submit a proof of residency document, such as a utility bill or rental agreement, alongside their passport and OCI card, to show they have been staying in India for the specified duration.
I informed my cousin, although OCIs who fulfill this residency requirement are eligible to receive an Aadhaar card, they do not have any additional legal status, privileges, or rights beyond identification in India.
Aadhaar is frequently just helpful for OCIs' internal personal identity in India. The Indian government has cleared that foreign nationals, including those with OCI, do not need to have Aadhaar to use its services or receive its benefits.
