No, housing societies cannot ban bachelors from renting an apartment. Every member of the society has the right to rent out his tenement at will and the society cannot restrict bachelors or spinsters. Housing societies do not have the legal right to snatch away the constitutional right of every citizen of India from residing anywhere in the country. Since there can be no better reason that can impede an Indian citizen from executing his /her constitutional right, legally – such rules will be overridden in the court of law.
