I was checking out some articles regarding wife share in husband property after divorce. And I was pretty shocked looking at the sarcastic tone of some articles! At certain times the wife tries to get hold of a husband’s property just for monetary reasons and jealousy but this is not always the case. We Indians only relate to Bollywood movies where the wife is just another golddigger! But is this the case? Are we all born in a family with silver spoon, ten Mercedes, and five houses? No! That’s what a movie shows.

If you look at any middle-class family in India, you will know how hard it is to earn a living and give kids a proper education. Forget having a house! And then comes the situation of a mother who is abandoned by her husband, a woman with no job, no family support, and literally no one by her side. Now, she has to take care of her kids! Where would she go since her family won’t let her in the house? In this situation, can wife claim husband property during divorce?

The answer would be yes! The wife will get 50% of her husband’s property if that property was purchased jointly. Also, after the divorce, the husband is supposed to return all the jewellery, policy funds, and fixed deposits that her family gave her or she invested in.
