I stay in an apartment, whereas my parents stay in a housing society. So I can share some points in this debate of apartment vs society. However, living in a flat or a community usually depends on one's priorities in life and personal preferences.

What is the Difference Between Housing Society and Apartment?

I’ll share a few points of differences that I am aware of;

Housing Society Apartment

In general, ten people—each from a different family—who live in the society's operational area and have purchased property in the building are needed to form a society. 

When it comes to apartments, anyone who owns the entire building can still form one as long as the building has at least five apartments.

When a society is involved, the building's and the land's titles are conveyed to the society, which then becomes the property's owner. 

In an apartment, each apartment's title belongs to the owner of the unit, who also has a proportionate undivided interest in the land that houses the building's common areas and amenities.

A society adopts the model bylaws on a periodic basis, making changes as needed but only after receiving permission from the deputy registrar of the relevant ward. 

Similar to this, appropriate modifications can be made when adopting an apartment's bylaws as long as the act's provisions are not broken.

The Managing Committee, selected by the society's members, is responsible for overseeing its affairs. 

Similar to this, the board of managers of an apartment is in charge of running its affairs; they are chosen by the association's members.

In a society, "Police Verification" and the Managing Committee's Permission are needed.

The Board of Managers' approval is not required for the owner of an apartment to lease or transfer their flat.

1) Variations in land rights

In a housing society, the developer or marketer loses all power over the apartments upon creation and transfer. And the complete parcel of land including the units is transferred on the Society's behalf. 

In an apartment association, every individual owner has full control over their personal flat or apartment. And the association's sole goal is to retain the residents and further the well-being of its members. It is along with preserving important facilities like water supply, sanitary conditions, road maintenance, lighting for shared spaces, upkeep of road network, and improving the safety of the apartment building's residents.

2) Choose the monthly maintenance cost

In certain apartment complexes, the developer continues to be in charge of the upkeep and controls parts of the non-saleable places. It includes places such as common areas, parking areas, terraces, stairs, etc. 

In addition, after a Society has been established and a completion certificate has been given, the developers no longer control any portion of the property.

3) Association for Dispute Resolution

The cooperative societies Act provides a specific dispute resolution venue for housing societies, and issues there can be resolved promptly. 

However, the Apartment Ownership Act, civil courts, and consumer forums are also available for the resolution of conflicts by apartment associations.

What are the apartment society rules and regulations:

  • The managing panel's major duty is to see to the correct upkeep of the apartment building and to address any associated problems that residents may encounter.

  • Since practically every person is aware of their rights but few acknowledge their obligations, encouraging them to behave in society's best interests is just as difficult.

  • They are essential to a society's efficient operation, and many see them as representing an apartment building.

  • They are necessary for an apartment complex group and essential for the smooth operation of society.
