I have been living in a rented accommodation with my friends. We all have our names in the rent agreement but our landlord does not give us the rent receipt for the rent we pay. I was sceptical about submitting the rent agreement and didn’t have the rent receipts to show that I pay rent. But then I came to know that HRA without rent receipt can be claimed after I asked one of my colleagues ‘Is rent receipt mandatory for HRA exemption?’

I am glad I asked or else I wouldn’t have been able to put the claim for HRA.

Anyway, since you are asking the same question: can I claim HRA without rent agreement and if so how much. Let me help you out. Yes, you can claim HRA without rent agreement but yes, there is a cap on that. As Mr. Srivasu mentioned, if your rent stands somewhere below Rs. 3000 per month then you can claim HRA simply without rent agreement or rent receipt.

It is not mandatory to submit proof in that case. But if you overstep the limit then you will have to submit rent receipt or a copy of your rent agreement. That is the rule.

Wondering to know how much HRA we can claim in ITR without proof. Let me tell you that it is subject to the following conditions:

  1. The actual HRA received from your employer.

  2. Rent paid for the accommodation, minus 10% of your basic salary.

  3. 50% of your basic salary if you live in a metro city or 40% of your basic salary if you live in a non-metro city.

The lowest of the above three amounts is you can claim without providing proof of rent receipts.

Remember to maintain rent receipts and other supporting documents in case the tax authorities request them during an audit. If the rent paid exceeds Rs. 1,00,000 per annum, it's important to provide the landlord's PAN (Permanent Account Number) to claim HRA.

Additionally, the HRA limit can change from year to year based on government policies, so stay up-to-date to the latest income tax regulations.

This is how HRA claim without proof.

HRA stands for House Rent Allowance. It is a part of the salary that the employer provides for rented accommodation. You can claim HRA exemption if you live in a rented house as per Section 10(13A) and Rule 2A of the Income Tax Act 1961. In many cities, the landlord does not provide rent receipts. I have gone through such a situation in Bangalore and learned about HRA claim without rent receipt. Many of you might not be aware of the process, so let me share this important piece of information with you. There are other HRA aspects that you must be aware of as well. How much HRA we can claim without proof?

If you really want to claim HRA, you have to have the PAN details of the landlord, rent receipts to cite the rent amount, and more. But even if you do not have them, you can claim HRA.

The maximum HRA exemption without rent receipt is up to Rs 3,000. You are not eligible to claim HRA if your rent exceeds Rs. 3,000. So if your rent exceeds this amount, ask for rent receipts from the landlord. If you do not get a rent receipt for rent above Rs. 3,000, you cannot get the HRA exemption.

Can I claim HRA without landlord PAN?

You can claim HRA without the landlord’s PAN card details only if your annual rent payment is less than Rs 1,00,000. If your rent amount exceeds Rs 1 lakh, you will need to obtain your landlord’s details. This is the HRA limit without PAN card.

I hope these details were helpful. If you live in a rented house, you should always be aware of any information or updates about tenant or landlord rules, agreements, or rent. This is all I know about the HRA claim without rent receipt.

I read certain articles a few years back which said that, in order to secure the HRA exemption and dodge taxes, a few employees submitted fictitious rent receipts. Additionally, there were instances where staff submit fictitious receipts that exceed the actual rent. Additionally, the government discovered that some property owners who rent out their houses were not filing their tax returns or paying any taxes on their rental revenue. As a result, the government decided to determine whether the employee is genuinely paying the rental stated on receipts by asking for the landlord's PAN card information with HRA exemption requests that total more than Rs 1,00,000 per year. But not everyone provides a rental agreement and if you want to know how to claim HRA without rent agreement, please keep reading.

What is an HRA without proof and how to calculate HRA?

Income tax jargon for HRA is house rent allowance. This indicates that under section 10-13A, the portion of compensation that was received for the purpose of paying rent may be deducted from the taxable salary. HRA exemption is only permitted for the least of the following: Real HRA employee receives (for non-metropolitan areas, 40% of salary; for metro areas, 50% of salary; and Actual rent paid at or below 10% of pay.

The salary would contain a base amount, a dearness allowance, and a predetermined commission percentage for the above calculations.

To claim the exemption for the house rent allowance, the employer will need to receive documents such as paying invoices and rental agreements. The PAN of the homeowner must be provided if the rent payment is greater than Rs 1 lakh annually. Employers would include a deduction for HRA in form 16 based on these justifications.

Although it is strongly advised to have rent receipts and rent agreement in place while claiming HRA at the time of tax deductions. But if you are paying an amount less than Rs. 3000 per month then you can just declare the HRA exemption amount. Any amount above this band requires proof.

If the rent amount is between Rs. 3001 and Rs. 8333 per month then you will have to produce the rent receipt with revenue stamp of Re. 1 and the signatures of the landlord. When rent exceeds Rs. 8333 per month, the rent receipts with revenue stamp of Re1, landlord’s signature and PAN card of landlord are mandatory.
