Under section 194-IB of Finance Act 2017 an individual of HUF is liable to deduct TDS on rent of property if the rent paid exceeds Rs. 50000 per month. It said that all the transactions of such nature shall attract the tax at 5% or 3.75% of the rent payment made by the tenant to the landlord. In order to know how to calculate TDS on rent, you should know what does rent actually mean under these circumstances.

Note: Individuals or HUFs who are liable to audit under clause a and b of section 44AB shall not deduct TDS.

This was information about TDS on rent of property. Let us now look at TDS on rent under Section 194I of Income Tax Act.

If you are someone who has rental income from land, building, plant, machinery, furniture and fittings, this is for you. According to Section 194I, a person (excluding an individual or HUF) who pays rent under an agreement or lease must deduct TDS. The threshold for tax deduction in such a case is set at Rs. 240000 for FY 2020-21.

Note: Individuals or HUFs who are liable to audit shall deduct TDS.

Section 194I defines rent as a payment made under lease or agreement for these assets; land, building, building including a factory building, land including a factory building, furniture, machinery, plant, equipment and fittings.

Rates of tax deduction for plant and machinery is at 2%, while it is fixed at 10% (5% if rent exceeds Rs. 50000 p.m for individual or HUF not liable to audit taxes) for rent of land, building, furniture or fittings.

Now let us see how to calculate TDS on rent with example under section 194 I of Income Tax Act.

In order to know how to calculate TDS on rent, you should know the TDS deduction rates as well. Here is what it looks like:

  • TDS percentage payable for plant/ equipment/ machinery: 2% of the rent paid
  • TDS percentage payable for land/ building/ furniture/ fittings: 10% of the rent amount paid, 5% `50,000 is paid per month as rent.

Now let us see how to calculate TDS on rent with example.

Suppose, Sandeep pays a monthly rent of 20000 for a machinery, here is how the TDS will be calculated.

2% of 20000*12 = Rs. 4800

Here is the process for

how to deduct TDS on rent with example

. The TDS rate on rent is generally 10%. If the annual rent payment exceeds Rs. 2.40 lakh, the TDS rate is 20%.

Let's say you are a landlord receiving monthly rent of Rs. 25,000 from your tenant.

  • Annual Rent: Rs. 25,000 x 12 = Rs. 3,00,000

In this example, the annual rent exceeds Rs. 2.40 lakh, so TDS is applicable at the rate of 20%.

  • Calculate the TDS amount: Annual Rent x TDS Rate

For the example: TDS Amount = Rs. 3,00,000 x 20% = Rs. 60,000

So, in this case, the tenant is required to deduct and deposit Rs. 60,000 as TDS to the government.

In India, the tenant deducts a specific percentage of tax from the rent payment provided to the landlord and pays it with the Income Tax Department. This is known as TDS on rent. This prevents tax evasion and guarantees that the landlord pays their taxes on rental income. You can use a TDS on rent calculator for calculating TDS on rent.

How to calculate TDS on rent with GST for Individual Tenants?

  • When the landlord has a PAN: Tenants are required to deduct TDS at a rate of 10% on the rent amount paid if their yearly rent payment exceeds 2.4 lakh.

  • When the landlord doesn't have their PAN: The tenant is obligated to deduct TDS at a rate of 20% on the amount of rent paid if the landlord does not have a PAN.

Example: Consider Mr. A as a renter who pays Mr. B, the landlord, 25,000 each month in rent. Mr. A pays ₹3,000,000 in rent per year. TDS is applicable in accordance with the law if the annual rent paid exceeds 2,40,000.

The TDS rate in this particular case is 10%, assuming Mr. B gave Mr. A his PAN information. Because of this, Mr. A must deduct 30,000 (or 10% of $3,000,00) as TDS. Mr. A must use Form 26QC to deposit the TDS amount with the Income Tax Department after deducting it from the rent payment.

TDS calculation on rent with example for Non-Individual Tenants?

  • When the landlord has a PAN:A non-individual renter is obligated to deduct TDS at a rate of 10% on the rent amount received if the annual rent paid by the tenant exceeds 2.4 lakh.

  • When the landlord doesn't have a PAN: If the landlord lacks a PAN, the tenant is obligated to withhold TDS at a rate of 20% from the amount of rent that was paid.

Let's use an example where ABC Pvt. Ltd. pays XYZ Builders a monthly rent of 50,000 for a commercial building. In a fiscal year (April to March), ABC Pvt. Ltd. will pay a total of 6,00,000.

According to current tax law, the TDS rate that applies to non-individuals will be 2% if ABC Pvt. Ltd. and XYZ Builders both have a valid PAN. As a result, 2% of ₹6,000,000 is what will be deducted from the rent paid to XYZ Builders by ABC Pvt. Ltd. as TDS.

The TDS amount of ₹12,000 must then be deposited with the Income Tax Department before the deadline and a TDS certificate must be obtained from the department.

The sole requirement is that you must subtract the tax after rent has been paid. Rent does not have to be deducted on a monthly, yearly, or other periodic basis by the renter. The fact that deductions are only permitted once the rent has been paid. Whether on a monthly, quarterly, or annually.
