Termination of cultivation by Bargadar

I want to tell you that nobody is entitled to terminate cultivation of his land by a Bargadar except in execution of an order, made by the authority or officer as the State Government may appoint, in case —

(a) the Bargadar fail to tender deposit to the full extent the share of the produce

(b) the land isn’t cultivated by the Bargadar personally;

(c) the bargadar has failed to cultivate the land, or has used it for any purpose other than agriculture;

The order for the termination of cultivation won’t be given in case the Bargadar provides the share of the produce or pays the market price to the owner of the land, within the time and installments decided by the appointed officer or authority.

Bargadar is a person who takes care of agricultural land. In this case, the owner of the agricultural land only possesses the land but all the work related to growing crops, planting seeds,  giving manure to the land, cultivating the land, bearing all the expenses to cultivate the land, etc. Therefore, it is the Bargadar who has to bear the entire cost of cultivating the land and he is the one responsible for hiring labourers to cultivate the land. The Bargadar are generally known as Abhidhaga or Bhag who cultivates other's land. This is what is bargadars meaning in simple words.

Now, I have read what Mr.Majnot has said about removing Bargadar from land. And I agree with him, that it is very difficult to remove Bargadar from land. Especially with the current political scenario, removing Bargadar from land is nothing but a dream come true. Therefore, I believe Bargadar in land law is hard to remove as of now. But you can talk to the Bargadar himself and come in mid-way and remove Bargadar. 

Besides what Mr.Majnot has added about the land record correction process in West Bengal, I would like to add who cannot become a Bargadar.

Any person who is related to the owner including:

(a) wife, or

(b) husband, or

(c) child, or

(d) grandchild, or

(e) parent, or (t) grandparent, or

(g) brother, or

(h) sister, or

(i) brother’s son or brother’s daughter, or

(j) sister’s son or sister’s daughter, or

(k) daughter’s husband, or (/) son’s wife, or

(m) wife’s brother or wife’s sister, or [(ma) husband’s brother, or]

(n) brother’s wife,],

cannot become a Bargadar.
