The government has approved that the Pagdi system houses can easily go ahead with the redevelopment of the project. According to the Brihanmumbai Municipal Corporation (BMC), it allows redevelopment of buildings with the consent of 51 per cent of the apartment owners (51% of 17 is around 8.6, so 9 tenants should agree for redevelopment out of 17 and you can proceed further). The tenant has little rights to get an apartment/society redeveloped unless the owners give their consent. The owner’s consent is the most important part. He/she should agree for the redevelopment process then only you can proceed further.

What are the redevelopment rules for tenants in Mumbai?

  • As per the guidelines of the Pagdi system, the tenants living in non-cessed buildings before June 13, 1996, shall be eligible to get new flats after the redevelopment of the building.

  • If the tenant has given a Pagdi property to another person after completion of legal procedures then the new occupants will be eligible for equal rights. So, the new person is eligible to get accommodation after redevelopment.

  • Tenants will get a minimum of 300 sq ft and a maximum of 1,292 sq ft without paying any money. Anything beyond the maximum limit is chargeable.
