I am living in my self acquired property for the last 40 years. My adult married son (38 yrs) is also living in the same property but independently. He along with his wife is creating daily nuisances even leveling false allegations like rape against me. We are senior citizens (70/66 yrs). How can we get rid of them, eviction from our property to live a peaceful life? He threatens not get out if I try to sell this property. Prospective buyer take it as disputed property and do not offer a reasonable price. Any solution to get him out please.

In 2017, the Delhi High Court ruled that the elderly parents who are abused by children can evict them from any type of property, not just a self-acquired one. The property can even be ancestral or rented, as long as parents are in its legal possession. An elderly parent can file an application to the Deputy Commissioner or District Magistrate to evict abusive children. In Delhi, the application is forwarded to the Sub-Divisional Magistrate, who has to send the report with final orders within 21 days. If the property is not vacated within 30 days, the DC can have it evicted forcibly. As per a high court ruling, the Senior Citizens Maintenance Tribunal also has the power to order the eviction of children.
