Q.

I bought Property From A Person Who Got The house As A Gift Deed From His Uncle. He did Registration of Gift Deed before selling the property to me. After purchasing, I did the Registration of property in my name. Now this person’s Uncle want the property back after 1 year, as the value of property shoot up to 3x. He is threatening him with court case and he is not aware about further sale of property. Will this effect me any way, as I’m planning to rebuilt place?

Can gifted property be taken back?

The giver cannot cancel a gift deed once it has been prepared and registered without the donee's approval. The beneficiary can revoke the gift deed and surrender his rights to the property. A person cannot claim back the property unless and until it is proved that the gift deed is done by force. You can ask the court to cancel the gift deed by filing a complaint under the Maintenance and Welfare of Parents and Senior Citizens Act.

Can gift deed be challenged after 3 years?

No, the registered gift deed cannot be disputed or revoked after three years from the date of issuance as per the law.
