Hello Datir, If your flat is in Maharashtra you can cancel your flat within 5 years from the date of registration. From the date of cancellation you have one year (This was six months before July 31 2024) to apply for refund with collector of stamps office. 1000 Rs will be deducted. Registration fees is not refundable after registration.
In India, the ability to apply for a stamp duty refund after canceling a property purchase depends on various factors, including the specific state's regulations and the terms of the sale agreement. Here’s a general outline regarding stamp duty refund:

1. Eligibility for Refund:

  • Generally, if a property transaction is canceled, the buyer may be eligible for a refund of stamp duty paid, provided certain conditions are met:
    • The cancellation should be formal and documented.
    • The sale deed should not have been executed or should be revoked.

2. State-Specific Rules:

  • Refund policies vary by state. Each state has its own Stamp Act, which outlines the conditions under which a refund can be claimed.
  • Some states may allow refunds under specific circumstances, while others may have stricter rules.

3. Application Process:

  • To apply for a refund, you typically need to:
    • Submit a formal application to the relevant state authority (e.g., the local sub-registrar or the stamp duty office).
    • Provide necessary documents, such as:
      • A copy of the registered documents.
      • Proof of payment of stamp duty.
      • The cancellation agreement.
      • Any other supporting documents as required by the state’s rules.

4. Time Frame:

  • Be aware of any time limits for applying for a refund. Many states have specific deadlines within which the application must be submitted.

5. Consult Local Regulations:

  • Since laws can vary significantly, it’s advisable to consult the specific stamp duty regulations in your state or seek advice from a legal expert or a property consultant.
