I have tenant in my apartment for last 9 years. I have 11 month leave and license Agreement signed with her. I want to give her one month notice to vacate my apartment as per Agreement. Does she have the right to refuse to vacate ? What are my remedies if she refuse to vacate?

As per the Maharashtra Rent Control Act, if a tenant has been in possession of a property for more than five years, they are entitled to protection against eviction. However, since you have an 11-month leave and license agreement with your tenant, you can give her one month’s notice to vacate the apartment as per the agreement.

If your tenant refuses to vacate the apartment after receiving the notice, you can file a suit for eviction in the court of law. The court will then issue an eviction order if it finds that the tenant has violated the terms of the agreement.

It’s important to note that you cannot forcibly evict your tenant or cut off essential services such as water and electricity. Doing so is illegal and can lead to legal action against you.
