I plan to buy a 10+ year old independent house in a BDA layout with clear titles. However, the construction has deviations from the approved plan. How do I go about getting this regularised?

In Bangalore, deviated constructions are not a rare occurrence. Usually, it is best to buy a property which has no deviation, however, a 5% deviation is considerable. Such deviations are permitted upon payment of regularisation fees, only on the condition that it does not affect the structural stability of the building as prescribed in the building by law. A deviation of more than 5% of the sanctioned plan is considered illegal. The builder will not get an OC if he crosses this limit. Three things are included while sanctioning the plan by BDA: plot coverage, floor area ratio and height of the building. Speaking about the regularisation of the already constructed building, according to a new scheme by BDA, you will be penalised with 10-50% depending on the site dimensions. The deviation can be regularised. Karnataka govt. has empowered the commissioner to do so. It also mentioned that the regularisation of sites might be limited to only 4,000 sq. ft or 50 x 80 dimensions.
