I want to buy a fifth floor flat in Delhi. However, it is not exactly on the fifth floor as there are two rooms on the terrace above the fourth floor. So before investing in the same, I would like to confirm the rules of East Delhi MCD. Has the government already allowed this or will it pass the rule in the future for a residencial building?

In East Delhi, the Municipal Corporation of Delhi (MCD) currently does not permit the construction of a fifth floor in residential buildings. As per the latest building bylaws, the maximum permissible height for buildings in most residential areas is limited to four floors plus a stilt parking area. 

Additional construction, such as rooms on the terrace, may be considered unauthorized and could face legal action, including demolition or fines. Future amendments to these rules depend on government policies, but no confirmed plans for approval of a fifth floor have been announced yet.
