The answer to your query, “Is witness required for rent agreement?” is No! The absence of a witness signature does not necessarily make your rental agreement invalid. 

Let me explain:

Legal Requirement:

  • Only the two parties entering into the agreement need to sign it, and the signatures do not need to be witnessed.

  • Despite there being no legal requirement for a signature to be witnessed, having a witness can prove helpful in evidence if a dispute arises about the validity of the agreement.

Role of Witnesses:

  • Witnesses are neutral parties who are not directly a party to the contract.

  • Their signatures give validity to the document.

  • Usually, witnesses are independent individuals who are not affected by the rental agreement.

  • Family members are generally not allowed to sign as witnesses.

  • Colleagues, friends, neighbors, or other non-beneficiaries of the property can serve as witnesses.

While having a witness is beneficial, the absence of a witness signature alone does not invalidate the rental agreement. Ensure that both the landlord and tenant have signed the agreement, and keep a copy for your records.

, if it is an 11-month rental agreement then registration of this rental agreement is not mandatory. The witness can be anyone, there is no strict rule about it. However, if the duration of the agreement is beyond 11 months then it would require a mandatory registration.
