As per my knowledge, according to current BMC regulations, residents who lived in pagdi system buildings before June 13th, 1996 and were not cessed are eligible for new apartments anytime their building is renovated. Additionally, the new occupant will be eligible for housing after redevelopment if a tenant has transferred the public system apartment in the name of another person after fulfilling the necessary legal requirements.
The new Development Control and Promotion Regulations (DCPR 2034) stimulate the redevelopment of these pagdi system buildings by providing landlords with enticing incentives based on the entire area needed to renovate the current tenants following reconstruction, the renters shall become the flat owners.
The developer will receive a 60% incentive FSI of the total area needed to renovate the existing tenants in the form of additional construction rights if two to five tenanted buildings are amalgamated for joint renovation. If more than five tenanted building plots are combined for joint renovation, the government will provide additional FSI amounting to up to 70% of the total existing built-up area.
