Is an Heir certificate necessary for establishing Tenancy Rights, where the original tenant has passed away? Or, is it sufficient to prove that the incumbent was a Co-Tenant/family member, staying in the premises at time of death of the Original Tenant?

Section 7 (15)(d) of the Maharashtra Rent Control Act 1999 states that a member of a tenant’s family who has been residing with the deceased tenant at the time of his/her death shall qualify first from the family as the successor to inherit the tenancy.

 

Therefore, you do not need their certificate for establishing tenancy rights, you just need to prove that you were residing with the deceased.
