  • HUF just grants a daughter-in-law the status of a member of the HUF but does not give the rights of a coparcener.

  • The daughter-in-law only has the rights to the HUF property through her husband’s share, either willfully transferred by the husband or received after the demise of the husband.

  • The daughter-in-law cannot claim any rights on the property which belongs to her in-laws exclusively. Hence,

daughter in law rights in father in law property are nil.

  • In the case of a deceased mother-in-law, her share will equally devolve amongst her children, and the daughter-in-law will acquire rights on her husband’s share only.

People want to know is daughter in law a legal heir or about the daughter in law right in ancestral property then do know that the daughter in law possesses very few rights over her husband’s property. The HUF, The Hindu Undivided Family has given them the status of being a member of the family after her marriage but regarding rights, there is no such mention.

Under what terms can she claim her husband’s property?

The daughter in law has right over her husband’s property through her husband’ share only but individually has no right. She cannot ask or claim for anything that belongs to her in-laws and such property can not be treated as a shared property as well.

After the death of the mother in law, a daughter in law can have right over her husband’s property that he has got but will not have any self-acquired property.

Which property can be claimed by a daughter in law?

As mentioned earlier, a daughter in law cannot claim any property from her in-laws but after the death of her husband, she can claim her husband’s property that can be both ancestral or self-acquired property.

Hindu, Muslim and Christian laws have granted the daughters, the permission to claim property of their father but none of these three religions have granted the right to a daughter in law to claim her in laws property.
