Being a tenant for the first time, I was worried about paying Rs 60,000. I asked some friends and even the landlord: is the security deposit refundable? And learned that yes. The security deposit is refundable. In most cases, a month’s rent is deducted from it so that the owner can use the money to paint or repair the property but the rest is usually refunded within a month.

Is Security Deposit for Rent Refundable?

As I said, security deposits for rent are refundable unless the rent agreement says otherwise. This deposit serves as financial protection for landlords against probable damages or unpaid rent. Upon the end of a lease agreement, landlords inspect the property for any damages beyond normal wear and tear. If the property is in good condition and all rent payments are up to date, the security deposit is returned to the tenant. Deductions can be made for damages or outstanding bills. 

If as a tenant, you do not get the security deposit returned within the stipulated time, you are free to file a civil suit against the landlord. It is thus essential that you go through the rent agreement thoroughly before signing and understand the terms of the security deposit clearly.

If you have ever rented a house, you must already know that landlords charge hefty amounts as security deposits. At the time of moving into the rented property, the renter must pay the landlord a sizeable security deposit. It is kept for the duration of the lease and returned when it is done. The fact that this money is set aside for unanticipated events that can occur during the tenancy makes it essential for the landlord. Are security deposits refundable?

The Model Tenancy Act, 2021 stipulates that the renter shall pay the security deposit in advance. In the event of a residential property, it cannot exceed two months' rent, and in the case of non-residential property, it cannot exceed six months. The security deposit is not taxed and must be returned after an inspection of the property is completed when the renter vacates the space. Notwithstanding the fact that a salaried employee's monthly rent qualifies for the House Rent Allowance (HRA) deduction under Section 10 (13A) of the Income Tax Act of 1961, the security deposit does not because it is a one-time payment. It is vital to know that the expense incurred in fixing any damage to the property caused by the renter such as holes in the walls or broken windows might be taken from the security deposit. However, costs to fix common wear and tear, such as paint that is flaking off the walls or wall paint that is fading, cannot be taken from the security deposit.

Refund of security deposits and other common rules

To protect the landlord's interest in the event of property damage or unpaid rent, a security deposit is required. According to the Model Tenancy Act, the landlord is allowed to take rent arrears and other repair costs from the security deposit before returning the remaining amount after the tenant vacates the property and the lease expires.

If nothing else is specified in the rental agreement, it is the landlord's obligation under the Act to take care of any necessary structural repairs, whitewashing, external electrical wiring, and other maintenance-related issues. The day-to-day maintenance of the home, including drain cleaning, switch and socket repairs, kitchen fixture repairs, and replacement of glass panels in windows and doors, will be the renters' responsibility. They will also be responsible for caring for housing wear and tear as well as maintaining gardens and open spaces.

Tenant and landlord can also agree on a price, and a legal rental agreement should be created to prevent any disagreements at the end of the tenancy.

The following requirements should be met by the agreement:

  • Both the landlord and the tenant must sign it.

  • The security deposit amount should be specified in the agreement.

  • It's a good idea to get a second opinion before you make a decision.

  • To prevent disagreements, the agreement should specify both parties' obligations in detail.

One way to obligate both the renter and the landlord to keep the property in good condition is through the security deposit. To prevent future annoyances, however, both parties must express their expectations on the security deposit in advance.
