Yes, termination of a rental agreement is legal after the end of the lock-in period of two years. As per the Maharashtra Rent Control Act, after the expiry of the leave and license agreement, if the licensee fails to vacate the premises, the licensor can recover possession of the premises by making an application to the competent authority. The authority, on being satisfied that the period of license has expired, shall pass an order for eviction of licensee.
If the lock-in period has ended, the landlord can ask the tenant to vacate the place with an immediate eviction notice. However, if the tenant refuses to vacate the premises, the landlord can file a rent control original petition (RCOP) and the court will carry on the proceedings as in a civil suit and pass an order of eviction after hearing both the parties. The eviction process usually takes around one to two years.
