MY MOTHER GAVE AN SRA PROPERTY GIFT DEED TO MY ELDER BRO AND SOCIETY TRANSFERRED THE DOCUMENT WITHOUT MY NOC. WHAT SHOULD I DO NOW?

If your mother gifted an SRA (Slum Rehabilitation Authority) property to your elder brother, and the society transferred the ownership without your NOC (No-Objection Certificate), here’s what you can do:

1. Verify the Lock-In Period: First, check if the lock-in period for the SRA flat has ended. Typically, there’s a ten-year lock-in period during which the flat cannot be sold or transferred except in cases of death or divorce of the original allottee.

2. Obtain NOC from SRA:

   • Apply for an NOC from the SRA office. Submit the original allotment letter, possession letter, identity proof, address proof, and any other required documents.

   • The NOC verifies your eligibility for transferring the flat.

3. Gift Deed Transfer:

   • Execute a gift deed between your mother (as the donor) and your elder brother (as the recipient). A gift deed transfers ownership without any consideration or money.

   • Register the gift deed at the Sub-Registrar of Assurances’ office by paying the necessary stamp duty and registration fees.

4. Transfer Society Membership and Electricity Meter:

   • After registering the gift deed, transfer the society membership and electricity meter to your brother’s name.

   • Submit the necessary documents to the housing society, including the stamped gift deed, NOC from the society, NOC from the SRA office, and other required proofs.
