My mother is 64 years old and owns a flat in one of the societies in Pune. Her next door neighbour (tenant) speaks loudly in the corridor at all times of the day and night on a daily basis. My mother politely requested her not to make noise in the common corridor but that arrogant lady started abusing and screaming at my mom. She said she isn't doing anything wrong and we should stop bothering her. This was at 12.30 am. On another occasion, her guests were smoking and talking loudly outside my mother's house at 2.30 am. I informed the security. The lady came and yelled at my mom that we shouldn't complain about her guests. What can we do about this arrogant noisy neighbour?

Hi buddy,

I would like to tell you that you can take legal action against such a noisy neighbour under Section 268 of the Indian Penal Act that defines this kind of behaviour. According to Section 268 of the Indian Penal Code, a person commits a public nuisance when they engage in any behaviour that endangers the safety of the general public or the residents of the area who own or occupy the property in question.

The mere fact that a common annoyance results in some convenience or benefit do not justify it. So, if your neighbour is harassing you in this way, you may make a complaint with the magistrate's court pursuant to Section 268 of the IPC.

Section 290 of the IPC defines the punishment for nuisance, which is only 200 rupees, but the court has considerably more power on such matters.

But I suggest, dialling 100 and complaining to the police is the best course of action because, after a police visit or two, the annoyance is most likely to end.
