My parents have a perpetual lease plot in Delhi in thier name. Sadly my father passed away and now we want to get it converted to my moms name and my name as 1st and 2nd holders respectively. i have 2 sisters , 1 abroad. My question are: 1) what are the documents required for name change ( i understand the procedure is called mutation in this case) 2) whether it would be easier to get it singlly in May mom's name alone or in all of our 4 names (mom, myself and 2 sisters) or ideal scenario in my and my moms name 3) is there any time frame by which time free hold of the plot is to be done? 5) if I miss this deadline, is there any penalty on the same

  1. If your father has died intestate, i.e., without a will, then his share will be distributed as per the succession laws, among all legal heirs.

  2. If you want to get that transferred in your name or any other name, others have to sign the NOC for the same.

  3. There is no time frame as such but it would be advised to get the documentation work done at the earliest to avoid unforeseen issues.

  4. If you miss the deadline, you’ll have to start fresh with the registration.
