I want you to know that as a tenant, you are responsible to pay for the repair of damages, but you can’t be held responsible for the general wear and tear arising out of daily use, such as discoloration of bathroom and kitchen tiles, fading of wall paints, etc. These are the tenant rights in India related to the painting.

Every deterioration that occurs owing to usage and isn’t due to mishandling or accidental, account for regular wear and tear.

If your landlord is forcing you to pay for the painting charges or isn’t reimbursing your security deposit, then you can go for formal negotiation, approach legal small-cause court, or contact local police.

I hope now you know the legal rights of tenants in India related to painting.

Hi there,

So, one of the common questions tenants ask is ‘should tenant pay for painting?’ At times, even the tenant and landlord argue over who will pay the painting charges. I have read what Ms Jayati has written for the question ‘are tenants responsible for painting?’ But I would like to point out that if a landlord includes in the rental agreement that the tenants need to pay for painting charges while vacating then as a tenant, one is responsible for the painting charges. So, before signing a rental agreement you should read the clause carefully. If you find any discrepancy you should talk to your landlord about the clause. The clause in the rental agreement can be changed if you find any problem.

Now, the question is as a tenant are you supposed to pay for painting the whole apartment? The answer would be no, unless you have signed an agreement where there is already an existing clause for the same. Tenants are supposed to pay formal normal wear and tear not for painting the entire apartment. If the landlord is not paying your security deposit saying you need to pay for painting the entire apartment, you can choose to file a case against him. Just go to the nearest police station and file an F.I.R.

Lastly, I would like to tell you that before renting an apartment you should ask your landlord ‘ is the landlord responsible for painting or the tenant?’ And ask him if he will charge for painting the whole apartment or for normal wear and tear. You can find other places to rent if the landlord asks for money to paint the whole apartment. While talking about this you can keep the conversation recorded on your phone as supporting evidence.

I hope you now know the answer to the question ‘should tenant pay for painting?’
