Home / Legal / Documentation / We have purchased a property from NCLT Kolkata by Court order through advertisement and e-auction. The default company did not mutate its assets and later became insolvent under the provision of the Banking and Insolvency Code 2016. Now the present company is trying to mutate their assets against the purchased deed in the respective B.L.& L.R.O. offices. Now the B.L.&L.R. O. has raised some issues during the mutation of such property. It raises some typical errors and mistakes of the sale deed of the default company whereas our mother deed is correct. The office also raises the due Khajna amount, possession enquiry as well soloana issue of the applied plot. Therefore the office doesn't entertain us properly. Then where should we go for rectification and will get relief?

You should consult with Legal Counsel and review the sale deed. Make sure it reflects the terms and conditions of the sale and has no discrepancies. For rectification, file an application with the NCLT to correct the mistakes in the sale deed. Pay the outstanding Khajna dues, it is a prerequisite for property mutation.

If the B.L.& L.R.O office continues to raise issues and does not cooperate, file a writ petition or take appropriate legal action to compel the mutation of the property in your name.
