There are several documents that need to be verified before buying a property in Bangalore. Here is the list: Sale deed A Sale Deed is the core legal document that provides you with the proof of sale and transfer of ownership of the property from the seller to the buyer. A Sale Deed has to be mandatorily registered. Mother deed It is the parent document that helps to trace the origin/antecedent ownership of the property from the start. It becomes essential to have this document when you own a property in Bangalore. Khata certificate There are two types of Khata in Bangalore - A Khata and B Katha. In simple terms, ‘Katha’ is an account of a person owning a property. ‘A Katha’ has properties listed under BBMP jurisdiction with legal property construction. While ‘B Khata’ properties are not constructed as per the government standards and have illegal construction and registration of such properties is quite difficult. Encumbrance certificate The Encumbrance Certificate (EC) is a record that shows all the registered transactions pertaining to a property in a particular time period. It is issued by the sub-registrar’s office under whose jurisdiction the property falls. RTC Extract/ Pahani The Pahani is a revenue record of tenancy and cultivation (RTC). It includes the rights, tenancy and crops details for the property (such as owners’ details, area of the land, land revenue details, water rate, soil type, nature of possession of the land, liabilities, crops grown etc). BIAPPA/ BDA approval The BDA (Bangalore Development Authority) or BBMP (Bruhat Bengaluru Mahanagara Palike) or BMRDA (Bangalore Metropolitan Region Development Authority) or BIAPPA (Bangalore International Airport Area Planning Authority) is responsible for approving a building plan. Without this approval, the construction is illegal. The authorization of the building can be approved by the jurisdictional Commissioner or an officer authorized by such Commissioner. Apart from this, you also need to look for: a. No objection certificate (NOC) from the bank if the property was bought on loan. b. No objection certificate (NOC) from the association/ Society office/ maintenance office. c. Completion Certification (if under construction) or Occupation Certificate (already completed) d. Conversion certification (if buying a land) - Conversion from Agricultural to Non-Agricultural land. As all the land in Karnataka is considered as agricultural land, it is mandatory to get this certificate to get the property registered.

However, I’d like to add a few more documents to check before buying a flat in Bangalore;

  • Land-use-certificate:

Before buying a property, it is necessary to check CLU (Change of Land Use). You may get all the necessary information from the CLU, which prohibits building residential homes on commercial or agricultural property. Demand the developer or builder to provide you with this certificate or a copy of the CLU to assure a risk-free land sale.

  • The Sale and Purchase Agreement:

One of the key documents to examine is the Selling and Purchase Agreement. It consists of an agreement between the buyer and the seller's set of terms and conditions. One illustration of this is the flat's price. The price of the apartment that both the buyer and the seller have agreed upon would be included in the contract.

  • The Building Approval Plan:

According to the requirements of the Building Bylaws, Master Plan, and Local Body Acts, the builder must get the necessary sanctions before beginning construction. There are two parts to this authorisation: Building plans A and layout approval B.

You should thoroughly review this document before purchasing properties in Bangalore. When applying for a bank loan, this letter is essential since it includes the required down payment from the buyer.
