There are various types of properties and in Indian law, there are different rules as per the law for property registration. If you have purchased a resale property then you should know what are the documents required for resale flat registration. Here I am proving a list of documents required for registration of resale flat in 2021:

  • Sale Deed:

Sale deed is the first and the foremost document required for the registration of any kind of property. While registering your resale property sale deed is required as this document carries the property transfer statement between the buyer and the seller.

  • NOC

You have to make sure that the buyer is providing you NOC certificate of the property. This certificate is the legal document which states that the property does not have any kind of loophole such as financial debts. Under property Act 1882 it is mandatory for the seller to provide the NOC certificate to make the property transaction transparent.

  • Title Deed:

This document states the type of property and its title such as residential property, commercial property, and the flat is constructed in a housing society or it is a builder flat.

  • Sale agreement

Once the sale is complete you will receive a sale agreement. This document is prepared by the lawyer and then you have to submit it to the city municipal authority.

  • Encumbrance certificate

When you purchase a resale property it is important to check the encumbrance certificate. This certificate is the evidence that the property is clear from all dues and all bank installments are clear. This certificate is required when applying for home loans.

These are the

documents required for resale flat registration.

Hi Buddy,

I am a realtor. I provide honest reviews about various upcoming projects in and around Mumbai city. However, with my years of experience in the real estate business, I would like to highlight the documents required for registration of flat. The documentation involved in a resale property purchase is frequently misunderstood by homebuyers. Too many legal technicalities can leave a potential purchaser perplexed.

Be tension free, and get expert help on end-to-end legal processes only with NoBroker Legal Services.

As you all know that a resale home has long been seen as a solid investment or end-use purchase. One of the main advantages of buying a resale property is that you may move whenever you choose or rent it out for rental money.

Unlike an under-construction property, a ready-to-move flat will allow you to save money on your current living expenses, which you can use to pay down your house loan instalments. Demand for resale properties has risen dramatically as a result of the added advantage over under-construction constructions.

Before making a final purchasing decision, a potential homebuyer must check or verify many legal

documents to check before buying a resale flat

.

All property buyers should double-check the paperwork involved in the purchase process to confirm that the property has a clear title of ownership and has received all relevant government permissions, which is one of the most important parts of the entire

process of buying a resale flat.

I would completely agree with Vidha and Parvinder’s answer of the

documents to check before buying a resale flat. However, I would like to add a few more points that you must check that will help you in the

resale flat purchase procedure

;

  • Plan for construction

A buyer must determine whether or not the property has a building permit. A building plan is usually approved by the local municipality. The property blueprint, equipment layout, and utilities are all included in the building plan. Any unapproved or extra construction faces being dismantled or being denied occupancy.

  • The clearance certificate for a home loan must be verified

The most recent statement from financial creditors, such as banks, is another vital document to verify when buying a resale property

  • Possession certificate

The builder issues the first owner a possession certificate. If you wish to acquire a resale unit, you must also obtain possession paperwork. At the moment of resale, this document is not re-issued; instead, the seller will send it along to the buyer

  • A conversion order

is a document that allows you to alter the status of your property from agricultural to residential or commercial. To avoid future legal issues, this document should also be validated

Finally, being an informed homebuyer is essential since it will eliminate all future legal issues. If necessary, homebuyers should obtain the assistance of a legal expert in reviewing all paperwork.

I would like to conclude my answer here about

the documents required for registration of flat. I hope this helps:)

I never recommend anyone to rush into purchasing a property as it is an activity that requires a lot of patience and time. I advise people to follow the proper resale flat registration process. Moreover, you should also know about the documents required for resale flat purchase if you don’t want to lose plenty of money and create a mess.

Documents Required for Resale Flat Registration

You are required to have the entire chain of agreements and documents related to the property. You should also obtain and verify every other agreement and paper related to the selling and buying of the flat to date. Check out the list of the required documents for resale flat:

Title Report:

It includes info related to its title holder’s name, tax rate, joint encumbrances along with details of liens, mortgages, and property tax related to it.

NOC from Bank

: This certificate ensures that the bank has obtained all the dues from the seller and there aren’t any more dues related to the flat.

Completion/Occupancy Certificate

: These certificates verify that the flat is built as per the approved plans and other legal rules of the authorities and can be occupied by residents.

Encumbrance Certificate

: It ensures that the property has no dues and all bank installments are clear.

Utility Bills

– Check the utility bills like gas bills, electricity bills, water bills, etc. to ensure all the bills have been paid on time.

Latest Tax Paid Receipts

: Check the latest tax receipts to ensure there aren’t outstanding dues attached to the flat.

No Objection Certificate (NOC)

: NOCs are provided out by different establishments like safety, electricity, gas, water board, sanitation, and more. A flat can’t be sold without giving NOCs to the buyer.

Title Deed

: Get the flat’s original ‘Title Deed’ that shows the sale and transfer of flat ownership from the seller to the buyer.

Sale Deed

– This document acts as the ownership proof for the flat’s sale in the future. You are required to register it in the Registrar's office after buying the flat.

Possession Certificate

– It is needed while buying a privately constructed resale flat. This document is given to the buyer after they have the flat’s physical possession.

Now you know about the documents required for registration of resale flat.

Resale Flat Registration Process

The procedure to register a new or resale flat is the same. You are required to submit all the required documents to the sub-registrar's office. As it is a resale flat, the seller and the buyer of the flat will visit the concerned authorities to register the flat in your name. You’ll be required to pay registration charges and stamp duty also.
