What are the HRA Rules for Central Government Employees?

The HRA amount is calculated based on the employee's basic salary, dearness allowance (DA), and the city in which they are posted. The HRA for central govt employees is a percentage of the basic salary and varies depending on the classification of cities into different categories (X, Y, and Z).

Cities are categorized into three classes based on their population, infrastructure, and other factors. Cities with higher living costs fall into higher categories.

  • X Category: Cities with a population of more than 50 lakhs (5 million).

  • Y Category: Cities with a population between 5 lakhs (0.5 million) and 50 lakhs.

  • Z Category: Cities with a population of less than 5 lakhs.

The Seventh CPC recommended HRA rates at 24%, 16%, and 8% of the basic salary for X, Y, and Z category cities, respectively. However, the rates may vary depending on the employee's posting location.

HRA received by Central Government employees is partially exempt from income tax under Section 10(13A) of the Income Tax Act, subject to certain conditions.

According to the central government HRA rules, the HRA exemption is the minimum of the following amounts:

  • Actual HRA received.

  • 50% of the employee's basic salary for X category cities, 40% for Y category cities, and 30% for Z category cities.

  • Rent paid minus 10% of the basic salary.

What are the HRA Rules for Central Govt Employees 7th pay commission?

In accordance with the 6th Pay Commission's suggestion, the Central Government paid employees who worked in other cities 10% of their basic wage as house rent allowance. But the most recent pay commission, the 7th pay commission, suggested a different proportion. 

  • For workers in other cities, the 7th Pay Commission suggested allocating 8% of matrix pay. The minimum House Rent Allowance, however, is equal to 10% because the lowest basic wage is Rs. 18,000 and the HRA is RS. 18,000.

  • According to the 7th Pay Commission's recommendations, the government changed the rates and rights of HRA for Central Government employees on July 7, 2017. This was accompanied by a notice saying that the House Rent Allowance will rise once the Dearness Allowance exceeds 25%.

The following requirements must be met by an employee in order to be eligible for HRA:

  • The employee must be a government worker who does not have government housing or who has not been given housing that is owned by the employer.

  • For HRA to apply, the employee must be receiving a pay component.

  • The employee must be paying rent for the house he/she is residing in.

What is the current HRA rate for Different Categories of Cities:

The cities in which central government employees choose to live have a sole bearing on how much HRA they receive. In this case, cities or towns have been divided into X, Y, and Z by the central government. Follow the list of HRA rates in the 7th Pay Commission to get a comprehensive idea;

  • X Class Cities (If a city has 50 lakh populations or more):

HRA is generally 24% of the basic pay.

  • Y Class Cities (If a city has a population ranging from 5 lakh to 50 lakh):

In the HRA percentage for other cities is generally 16% of the basic pay.

  • Z Class cities (If a city has a population of less than 5 lakh):

It is generally 8% of the basic pay.

Rules and Regulations Related to HRA for Government Employees:
  • The employee must be a government employee who does not have government housing or who has not been given housing that is owned by the company.

  • The HRA % varies based on the city of residence.

  • The HRA cannot be greater than the employee's actual rent payment.

  • Employees are not eligible for HRA if they live in a home that belongs to their spouse.

  • The employee is required to pay income tax on the HRA they received.

Tax Benefits and Exemptions:

The Income Tax Act's Section 10(13A) allows an employee who receives HRA and lives in rented housing to claim a tax exemption. The exemption must include at least one of the following:

  • Actual HRA received

  • Rent paid minus 10% of the basic pay

  • 50% of the basic pay if residing in a metro city or 40% of the basic pay if residing in a non-metro city

Employees who pay rent for housing but do not receive HRA are eligible for a tax deduction under Section 80GG of the Income Tax Act. The maximum monthly deduction is Rs. 5,000, or 25% of the total income, whichever is less.

It is important to remember that in order to qualify for tax advantages and HRA exemptions, the employee must show proof of rent payment.
