What is ancestral property in India?

Any property that has been passed down from one generation to another can be classified as ancestral property. Your grandfather's property can be counted as ancestral property. It will be passed down from grandfather to father and from father to you and from you to the next generation. To be technical Hindu succession Act states, ancestral property meaning is any property that is at least four generations old and has not been divided by the previous generations.

  What is ancestral property in Indian law :  

According to the  Hindu Succession Law, there are 2 different types of property in Indian law. One of them is ancestral and the other one is called self-acquired property. 

 

For the longest time, only the male members of the family could inherit the ancestral property. Legally speaking, the inheritance was strictly set on male lineage. Female family members could not inherit the property of their father or grandfather.

 

As my lawyer friend was sharing, there have been a lot of changes in Indian property law. Now, women or the female members of the family can be part of the inheritance. The women of the family can claim properties. This is another step taken by the government towards equality.
