Having properties on rent has been carried in India for a very long time. As time passed the rules for tenants and landlords kept on changing. Here I shall talk about the Delhi Rent Control Act. This act came into force in 1958 and many changes have been made till 2020.

What is Delhi Rent Control Act?

Delhi rent control act was introduced after the partition of India. When many people started living in Delhi on rented properties in 1958. The government took this step to help the population of Delhi who were living in rental homes. This law has

provided the rights to tenants against untimely eviction.

If the rent is less than Rs. 3500/- then rent Control Act is applicable.

Rules for landlords under Delhi Rent Control Act
  • Under this act, the landlord can raise the rent by 10% once every three years.

  • This act states that the landlord has no right to evict the tenant if he/she is paying the rent on time.

  • The landlord can increase the standard rent only up to 10% if the property is renovated.

  • Not all properties or all areas come under this act. Delhi Rent Control Act section (1) describes on which area and on which property this law is applicable

What is it?

It is an act that has been created by the government of India to control matters related to rent amount, evictions, and rates of hotels and rental houses. The act also includes information about leasing empty premises to the Government. Delhi Tenancy Act has details about all the points mentioned above concerning the Union Territory of Delhi.

It is known as Delhi Rent Control Act, 1958.

The act has been created to ensure the interests of homeowners and tenants are represented equally. Since the tenant pays a rental fee in exchange for leasing the landlord's property.

What is mentioned in the Act? Rent increase :

Regulations have been set in the rent act Delhi because of which landlords are not allowed to increase the rent amount each month arbitrarily. For residential properties, rent can only be 

increased by 10 percent. This takes place every two years. Other details about the same are mentioned in Sections 6 & 8A of the Delhi Rent Control Act.

Amount:

The Rent Authority has fixed a standard rent amount. For any additional furnishing done by the landlord, they can imply an additional charge on the tenant. 

  Latest Updates :

In June 2021, The Union Cabinet of India approved the Model Tenancy Act. The act holds regulations about tenancy and renting. They have asked states in the country to adopt it. This means that the Delhi Rent Control Act, 1958 will be repealed soon enough and the newly formed rent act will be implemented.

The government of India introduced the Delhi Rent Control Act, 1958 to safeguard migrants living on rent in Delhi. The motivation behind this ad was to help people resettle after the partition and facilitate the social acceptance of the families in Indian society.

Under this act, the rights were given to tenants to protect them against untimely eviction.  The Delhi Rent Act also provided protection to the economically weaker sections, who couldn’t apply for loans or afford a home, from homelessness. This act provided tenant rights in Delhi.

Rent Control Act Delhi

A ceiling was put on the rent by the government under the Delhi Rent Control Act, which also created disinterest among investors. That’s why this act was amended in 1988 to exempt properties commanding monthly rents of Rs 3500 per month. However, so far, landlords don’t have the right to revise the rent.   • The act enables the tenants to sublet the property and the landlord isn’t allowed to object to it.

  • The Act enables increasing the rent by 10% every 3 years

  • The landlord can only increase the house rent in case they renovate the house. However, the rent can’t increase more than 7.5 percent of the total cost incurred.

  • The Act doesn’t allow the landlord to evict the tenant in case the rent is paid timely

  • The tenant can request a rent receipt from the landlord

  • The Act enables a tenant to pay their rent by the 15th of every month in case the date isn’t specified in the rental agreement.
