When an individual takes someone else's/owner’s property without prior consent and with the intent of permanently depriving the owner of its use or possession, it is deemed as theft. The most common example of theft is shoplifting where a person steals items on display in a shop. Another term for the act is larceny.

Burglary:

According to Theft Act, “burglary is committed when an offender either:

  1. a) as a trespasser enters a building/house/ flat with the intention of stealing, inflicting grievous bodily harm or doing unlawful damage; or,

  2. b) having entered as a trespasser steals or attempts to steal, or inflicts or attempts to inflict grievous bodily harm.”

 

Under the scope of the law, burglary carries a wide range of felony charges and penalties. The severity of the punishment increases as the level of possible harm raises as well. There are states that impose 5 to 10 years of a prison sentence for bulgarising a non-residential structure. If the structure is occupied ( residential/commercial) then the penalty could increase to a maximum prison sentence of thirty years.

 

There are two types of burglary, domestic burglary and non-domestic burglary. It can occur in a house, flat, boats and vehicles, domestic outhouses or garages. eg . If a person goes into a storeroom and steals something, that is known as burglary.
