I recently came to know about the concept of enemy property in a Facebook post. Until then I did not know

enemy property meaning. The

Enemy Property Act of 1968, (EPA) is an Indian law that allows the Central Government to take over and manage the properties of citizens and companies of nations that India has declared as enemies. The act was passed in 1968 and was amended in 2017. The act provides the government with the power to freeze the properties of enemies and to manage them in the best interest of India. This is the simplest answer for

what is enemy property in the enemy property act.

  Who manages the enemy properties?

The Custodian has to manage the enemy properties in the best interest of India. The person is also responsible for ensuring that the properties do not fall into the hands of the enemy and also for the preservation of the properties. The Custodian is appointed by the Central Government and is responsible for managing the enemy properties. He/she has the power to transfer the enemy properties to any person or institution, on behalf of the Central Government as well.

Can anyone sell the enemy properties?

The act also provides for the rights of the legal heirs of the enemy property holders. The legal heirs of the enemy property holders can claim their right to the properties after providing their relationship with the actual owner.

Previously the custodian could not sell it but now the person or any authorised body can sell it. In that case, prior approval from the central government is required. Such properties are sold in public auctions or other methods of sale.

I know auction properties are affordable and safe to buy yet I would suggest you consult with some legal experts, verify the documents and then only proceed to buy such properties.

This is all I know about enemy property.
