What is Karnataka Tenancy Act?

I learnt about the Model Tenancy Act Karnataka, 1999 (KT Act) when a friend of mine got into an issue with his landlord. His landlord has abruptly increased the rent and he was really stressed and looking for answers everywhere. I knew about the Act, so we did some research and found out that the Tenancy Act Karnataka states the relationship between tenants and landlords in Karnataka. This Act is applicable to all kinds of premises except for boarding houses and hotels.

Karnataka Rent Control Act 1999

Now I will tell you about the Karnataka Rent Control Act, 1961 (KRCAct). This law was superseded by the Karnataka Tenancy Act in 1999. But you should know that the Karnataka Rent Control Act is still applicable to certain premises especially residential which were rented out before 1961.

The major difference between the Karnataka Rent Control Act and the Karnataka Tenancy Act is that in the KRC Act, the Rent controller held the power of fixing the rent. While in the KT Act, the standard rent is fixed with the help of a formula.

Responsibilities of a Rent Controller

  • The Rent Controller has powers vested in them in the civil courts through which they can hold enquiries about a rental issue. 

  • They can also appoint people who have good knowledge about the issues and can advise them in the enquiries and proceedings.

  • The Rent Controllers are also required to settle the proceedings and enquiries within 6 months or less. 

  • The Rent Controller is also considered to be the prescribed authority for the tenants and landlords to file their rent agreements within 90 days after the agreement is reached.

  • The Act applies to all residential buildings, except those buildings whose standard rent is below 3500 per month and Rs 2000 per month in other areas.

  • As per the

    Karnataka Tenancy Act,

    the plinths of commercial buildings should not exceed 14 square metres.

  • A building is exempted for 15 years from the date of completion or in case of “substantial” renovation.

  • It is mandatory to have a registered rent agreement or a rent deed in writing.

  • Premises belonging to the State, Central Government or a local authority, Muzarai, religious or charitable institutions, or Wakf are exempted.
