I also had this question when I came across these charges. But when I got to know about it in detail, I decided to pay it regularly to the respective housing society with no offence. A non-occupancy charge is an amount charged from the owner for not residing in the property or flat. It may be charged when an apartment is not self-occupied or occupied by a member of a close family and the owner uses the property for financial gain. Individual leaseholders of flats that are not actually occupied must pay non-occupancy fees to their housing societies. If both the landlord and the tenant agree to the leasing agreement, the non-occupancy charges may become the renter's responsibility. Let’s find out what is non occupancy charges.

Non occupancy charges calculation:

Maharashtra's government issued a notification under Section 79A of the Maharashtra Cooperative Societies Act, 1960, which states that non-occupancy costs cannot exceed 10% of the society's service charges.

For instance, consider a society that charges Rs 5000 for a member's monthly maintenance, including Rs 4000 in additional fees. Then you will be charged Rs.400 as non-occupancy charges which are 10% of the additional fees. It is collected by the respective housing society by law. These charges should be paid to society on a monthly basis without any offence. These are the non occupancy charges as per bye law.

Non-occupancy charges rule:

1) A property owner is not accountable for paying non-occupancy fees to society if he lives in the property.

2) A society can charge non-occupancy charges when an individual's property is given on leave and licence or becomes vacant.

3) Non-occupancy charges are waived if family members reside in the property, such as a son, daughter (married or single), kids and grandkids.

4) The housing society can charge non-occupancy fees of about 10% on a monthly basis from the owner of the flat.
