A notice of intimation of the property’s mortgage is made to safeguard the interests of society and banks as stated in Registration Act, 1908 (Section 89B). Previously, the mortgage-related intimation/agreement by the way of deposit of title deed was kept out of the public eye. This was the reason for fake practices such as taking loans from several banks on the same building. This is why these modifications came into effect to stop frauds like that. Online or electronic filing of the notice of intimation in case of mortgage by way of deposit of title deed was brought from 01-04-2013:
  • The mortgagee and the mortgagor are required to sign a registered contract. The usual registration period is 4 months from the signature date.
  • In case the agreement isn’t signed, the mortgagor has to file a notice within thirty days of the closing date of the mortgage.
  • Non-filing of the notice of intimation/non-registration of the agreement could harm the interests of the parties by jeopardizing the validity of the mortgage.
  • In case anybody does not file such notification within the relevant time frame, then he will be penalised for the same.

The paperwork is submitted to inform the proper authorities that a mortgage loan has been funded. The new regulation, which became effective on April 1, 2013, aimed to stop real estate fraud, such as multiple registrations of the same home or multiple loans using the same asset as collateral.

Just to reiterate, I’d say that as Kamal said, any loan amount would incur a 1000 Rupees Notice of Intimation fee if submitted online. Additionally, the NOI fees or the document processing fee would be Rs. 300 if you are paying the Notice of Intimation in person at the SRO office.

  • A ‘Notice of Intimation (NOI)’ is a notice which is a part of the home loan registration process. 

  • It is submitted in order to inform the registrar office regarding the disbursement of a home loan. 

  • When you apply for a home loan, the money lending institution or the bank prepares an agreement, and both the parties agree to its terms and the registration of this agreement is done. In such a case, there is no need for NOI. I hope you are somewhat familiar with

As I informed you I bought a flat in Mumbai and we opted for e-filing of notice of intimation, we had to login to the registration and stamp duty website of Maharashtra. The overall process took Rs. 1000. I got to know later that this price is fixed and it doesn’t vary for loan amounts as in the case of stamp duty and registration charges. 

If you want to save some money and do it at a lesser cost, then you will have to invest time and energy. You will be required to visit the SRO office and pay the document handling charges of Rs. 300 only.

Is notice of intimation mandatory?

I spoke about the nature of notice of intimation. This is what I was coming at. Although it is advisable, filing Notice of Intimation is not necessary. It is a part of the home loan process as I mentioned and when an agreement is made, signed and registered then it is not mandatory to file notice of intimation. 

However, If no agreement is signed between the mortgagor and mortgagee, then the mortgagor has to file a notice of intimation. It should be filed within 30 days from the date of the mortgage.
