I came to know about this concept
when I was enquiring about a plot. I wanted to buy that piece of land but then I got to know that the land was leased to someone who was a permanent tenant. Let me explain to you what I have understood about this type of tenant.
What is P
ermanent Tenant meaning?
A permanent tenant is someone who, under the Act, is entitled to a tenancy for any land used for agricultural purposes, with the tenancy's duration being equal to the inamadar's tenure.
However, if the inamdar is a place of religious worship, this term does not include anyone who maintains the institution or performs religious services there as a priest, pujari, archak, mulla, kazi, mutawalli, muthsaddi, or holder of a position similar to that title.
It also does not include anyone who performs any service in any such institution and benefits from any land included in the institution's inam without paying rent in kind or in cash to the institution for that land.
A permanent tenant is a person who cultivates land on their own,
whose tenancy's beginning or duration cannot be satisfactorily proven due to its antiquity
whose name or the name of their predecessor-in-title has been entered as a permanent tenant in the record of rights, in any public record, or in any other revenue record
or who holds the land on a permanent lease by custom, agreement, a court's order
or who holds the land as mulgenidar, mirasdar, or khata kul;
and includes anyone whose tenancy is presumed to be co-extensive with the duration of the landlord's tenure.
I hope now you understand about permanent tenant.
