Persons Competent to Transfer: 

According to this section, every person competent to contract and entitled to transferable property, or authorized to dispose of transferable property not their own, has the competence to transfer such property. This transfer can be either wholly or in part, and either absolutely or conditionally. The extent and manner of transfer must align with the provisions of any law currently in force.

  • Competence to Contract

    : Refers to the legal capacity to enter into contracts.

  • Transferable Property

    : Includes both

    moveable

    and

    immoveable

    property.

  • Authorized to Dispose

    : Even if the person is not the owner, they may have the authority to dispose of the property (e.g., an agent acting on behalf of the owner).

  • Conditions and Limitations

    : The transfer must adhere to any legal restrictions, conditions, or requirements applicable at the time of transfer.
