A stilt parking is a partially covered parking space on the ground floor of a property. Usually, the length of the stilt parking is 8 feet. As the name suggests, a stilt parking is built on poles/posts or pillars with four open sides. It is preferred in metropolitan areas like Delhi and Mumbai where the land area is limited as it saves space. 

There have been a few concerns that have been raised against stilt parking and its safety, but many developers and builders have argued in favour of them as the safety can be ensured with effective designing techniques.

Is stilt parking mandatory?

No, stilt parking is not mandatory. However, the space in urban areas especially the metro cities is limited, many new projects have a stilt parking structure in their designs. In fact, the Government of Delhi announced its plan to offer additional floor areas ratio to buildings offering stilt parking. Hence, several housing societies in the national capital region (NCR) are opting for four-floor constructions built on top of an eight-foot-high stilt parking space. The Government has made it mandatory to have stilt parking in new apartments spread across the area of 100 to 1000 sq meters.

Can stilt parking be sold separately?

No, stilt parking is accounted as a common area of use within a residential or commercial property. It is for the usage of all the accommodators of the property hence, it can't be sold off separately by the developers or builders.

A builder is supposed to offer stilt parking to the homeowners as a part of common amenities. Now, the question is whether they are allowed to rent or sell the Stilt parking space or not. Let’s find out the answer:

The Supreme Court passed the law in 2010 stating that the builders can’t rent or sell the parking spot as buyers pay for the parking spots every year. The builders do not own any authority in utilising the Stilt parking for commercial purposes.

Important note for buyers:

As a buyer, you should always ask builders for the building plan approvals, if you’re purchasing a home in such a society. These approvals will clearly state the number of parking spaces, as approved by the authorities. Builders are required to submit an undertaking that mentions that the buildings follow safety norms and are well-designed, in case the structure has stilt parking.
